6.3 Aligning IP Policy with Public Benefit (Post-Bayh-Dole Review)
Policies governing publicly funded research must be re-evaluated to ensure the maximum public good is realized, resisting the default privatization of foundational knowledge:

6.4 Governing Scholarly Communication for Resilience and Equity
The long-term resilience of scholarly communication requires breaking the centralized control of the publishing oligopoly and securing knowledge assets against systemic threats:
1. Funder Leverage to Support Non-Profit Infrastructure: Policy must utilize the financial leverage of major research funders to aggressively support non-oligopoly infrastructure. This includes mandating the use of, and providing targeted funding for, independent preprint servers and non-profit, decentralized peer review consortia (such as the PCI model).[21, 22] This redirects resources away from the expensive APC model [44, 47] toward systems that genuinely democratize access and reduce long-term costs.
2. Decentralized Archival Mandate: Institutional mandates should require that critical digital archives, particularly those related to cultural heritage and research data [54, 55], adopt decentralized storage solutions, often leveraging Web3 technologies like Filecoin.[56] This strategic move ensures long-term data security and permanence by protecting against single-point failure, technological obsolescence, and organizational instability.
3. Enhance Policy Capacity and Systems Thinking: To effectively navigate these interconnected challenges, institutions and governments must invest in their policy capacity—the specialized skills necessary for evidence-based policy making (EIPM).[57] Policy development must adopt a systems perspective, acknowledging how different elements (technology, economy, trust) interact and evolve over time, thereby ensuring interventions account for both intended and unintended consequences.[58] The ability of knowledge governance to succeed is predicated upon this enhanced capacity for sophisticated diagnosis and strategic planning.[57]
VII. Conclusion
The future of knowledge and the institutions built to steward it are defined by an escalating tension between technological acceleration and institutional inertia. Generative AI offers powerful optimization tools, but its potential benefit is undermined by ethical opacity and systemic biases that, if unchecked, favor aesthetically pleasing, uncritical outputs.[4, 12] Simultaneously, the economic imperative driving universities to prioritize market relevance is being stymied by internal governance rigidities—particularly the failure to integrate high-value, modular credentials into rigid accreditation and transfer frameworks.[16, 17]
Success in this new knowledge landscape requires institutional governance to prioritize boundary management and verifiable transparency. This involves:
1. Shifting the Trust Paradigm: Moving decisively from a reliance on established source authority (which is compromised by deepfakes) to technical standards of digital provenance (C2PA).[9, 19]
2. Aligning Governance with Agility: Reforming accreditation and transfer processes to facilitate, rather than resist, the adoption of specialized, market-driven micro-credentials.[14, 16]
3. Decentralizing Resilience: Supporting community-driven knowledge validation (peer review) and deploying decentralized archiving solutions to mitigate the risks associated with centralized economic and political control.[22, 56]
Failure to address the misalignment between centralized governance models and distributed, agile technological disruption will accelerate the outsourcing of expertise validation to corporate entities and further erode public faith in academic and civic institutions. Strategic intervention now, centered on system-wide transparency and evidence-based governance reform, is critical to ensuring that knowledge institutions remain reliable, relevant, and resilient generators of public good.
